Following a 26-month legal battle over a patent related to the shock-absorbing WaveCel technology, Burton has announced in a press release that a German court has ruled that Koroyd’s patent No. EP 1694 152 B1 is invalid in Germany. Koroyd may appeal the decision. In the fall of 2022, Koroyd had announced that it had won a first-instance victory in Düsseldorf in its patent infringement case against Burton in the same matter.
A similar lawsuit was filed jointly by Smith Sport Optics and Koroyd against Burton in the US some time ago. They claim that WaveCel material used by Burton in some helmets infringes their joint US Patent No. 10,736,373. This case is still pending.
