The controversial legal battle between Adidas and luxury label Thom Browne will return to court to determine whether a new trial is justified. The New York District Court will hear arguments on intent following the discovery of four new emails that recently surfaced during litigation between the two parties in the UK but were not included in US trial documents. The emails address whether the defendant knew that using the stripe design on athletic apparel would cause confusion with Adidas’ Three Stripes trademark.
The Southern District of New York federal court jury ruled in favor of Thom Browne in January, while Adidas was seeking around $8 million in damages.
