The State of New York has banned the production and sale within the state of clothing and other textiles containing perfluoroalkyl and polyfluoroalkyl substances (“PFAS”). The legislation is set to go into effect on Dec. 31, 2023, after Governor Kathy Hochul signed off on Senate Bill S6291A earlier this month. The bill “prohibits the use of perfluoroalkyl and polyfluoroalkyl substances in apparel as an intentionally added chemical.” PFAS chemicals have increasingly been the target of environmental organizations, which seek to restrict their use due to safety concerns for humans. The State of California passed a bill to end the use of PFAS in new fabrics and textiles across the state in August 2022.
