Nordica and Icon Health & Fitness are again in a legal dispute over trademark rights, as Nordica filed a complaint in a U.S. court stating that Icon breached a 3-year-old contract by continuing to pursue the NordicTrack trademark for certain items in some countries. In a 2003 settlement it was decided that Icon could only use NordicTrack and Nordic Track trademarks on items including men’s and women’s shorts, socks, women’s bras, women’s tank tops and towels. Also included are gloves for indoor fitness, women’s indoor fitness vests, men’s and women’s long-sleeve shirts and tank tops, women’s spandex pants or shorts and men’s leggings. Icon could additionally use the trademark for gymnastic and other sporting articles based on that settlement, with the exception of items used for outdoor winter sports.
