The European Commission has sent out a formal letter to Slovenia's Ministry of Finance regarding the recovery of €10 million in state aid given to Elan. The letter is apparently requesting an urgent update on the steps that the Slovenian government is taking to obtain the reimbursement of the alleged subsidies. We hear that the government is planning to respond this week. Meanwhile, Elan has circulated a statement pointing out that the ski company and the Slovenian government have asked the European Court of Justice in Luxembourg to invalidate the European Commission's argument that the aid given to Elan was potentially illegal. It adds that the Slovenian state, which controls Elan, “will soon take further steps related to the sale of Elan, which should resolve the issue.” A member of Elan's management said that he could not comment on the sale process because of a non-disclosure agreement.
