The ongoing legal action again Cybex International is finally over with a settlement. The maker of fitness equipment has settled the lawsuit, Barnhard vs. Cybex, in which a woman claimed she was injured by one of the company's machines. Cybex will pay about $19.5 million to the plaintiff, with $18.5 million being paid when the settlement is completed and the remainder going out over seven years. Cybex will be released of all further liability related to the action. It will pay the settlement from available cash, its line of credit and additional financing. The final settlement is well short of the $66 million that a court ordered Cybex to pay in December 2010, and the $44 million an appellate court ordered in November 2011. The resulting $30.1 million reduction in litigation charges allowed Cybex to post net income of $34.7 million for the fourth quarter of 2011, against a loss of $57.1 million in the year-earlier period. The quarterly revenues rose by 8 percent to $43.0 million, with increases of 3 percent in the U.S. and 20 percent elsewhere. Full-year sales grew by 14 percent to $140.1 million, and the company had a net profit of $34.2 million against a loss of $58.2 million.
