Arena’s management has not yet decided whether to go all the way to the French Supreme Court after the Appeals Court of Bordeaux confirmed a lower court’s verdict regarding the shutdown of its Libourne factory in March 2007. While reducing the assessed damages to €3 million from €4.8 million, the court justified its verdict with the conclusion that the company’s move had been dictated by a desire to improve its own profitability rather than by economic constraints.
