Brooks Sports has filed a lawsuit against Nike, Exeter Brands Group and Payless ShoeSource in a U.S. district court, alleging significant trademark infringement and unfair competition related to the Tailwind athletic footwear sold by Exeter, a subsidiary of Nike, and sold exclusively at Payless ShoeSource outlets. In the suit, Brooks claims that the Tailwind brand bears a logo remarkably similar to its own, and that the design of the Tailwind G Zone model has an uncanny resemblance to Brooks’ Trance 5 running shoe. Brooks is requesting that the defendants permanently cease using the logo, recall all Tailwind labeled products and abandon the U.S. trademark application of the Tailwind brand.
