A group of US customers feels misled by the Fabletics VIP membership program and has filed a lawsuit against the company.
Sportswear company Fabletics has been slapped with a class action lawsuit in the Central District Court of California by a group of its customers, who claim it is misleading them by overvaluing its VIP membership program.
According to the lawsuit, the program has an auto-renewing $59.95 monthly fee that gives members a promotional credit that allows them to receive any single item or two-piece outfit that costs up to $100.
However, most of the items do not exceed the cost of the monthly membership fee, the suit alleges, and the credits expire if not used within 12 months of issuance. In addition, the plaintiffs allege that Fabletics fails to inform members of the program’s automatic renewal. The lawsuit seeks class certification, restitution, injunctive relief, damages and fees.
