Lululemon reportedly intends to appeal the infringement ruling.
A New York federal jury has awarded Nike $355,340 in damages in a legal battle against Lululemon after agreeing that Lululemon’s Chargefeel, Strongfeel and Blissfeel sneakers infringed a Nike patent that covers “an upper for an article of footwear, [with] the upper incorporating a textile element formed with a knitting machine.” Nike had requested at least 5 percent of Lululemon’s revenues from the allegedly infringing shoes, according to a court filing. Meanwhile, the jury rejected similar claims that Lululemon’s footwear infringed a second Nike patent.
As reported by Reuters, Lululemon intends to appeal the infringement ruling, which will not affect its products.
The case is Nike Inc v. Lululemon USA Inc, U.S. District Court for the Southern District of New York, No. 1:23-cv-00771.
