Nike has filed a breach of contract and confidentiality lawsuit against a former designer, Ann Margaret Cerciello, who was fired by the company last June because of “unsatisfactory performance.” The complaint alleges that Cerciello threatened to take confidential information about Nike to her potential employer, Under Armour. Nike’s evidence of this is from an e-mail that a current Swoosh employee received from the seemingly disgruntled designer. The company was prompted to take legal action after Cerciello refused to sign an affidavit stating that she hadn’t kept any Nike information and/or drawings. The company alleges that she misappropriated information related to pricing data, apparel designs and fabric information. A recent hearing for a temporary restraining order against Cerciello was cancelled, suggesting that a settlement could soon be reached.
