Production Systems SAS, a Paris-based design firm that conducts business under the trade name Production Type, is suing Nike for allegedly using portions of its Kreuz font software without authorization. The lawsuit was filed in a New York federal court on Feb. 13. According to the French company, Nike purchased only two single-user desktop licenses and one single title audio-visual license for the “Kreuz Condensed Light” font in December 2019. However, Nike further downloaded and used trial versions of the copyrighted “Kreuz Condensed Regular,” “Kreuz Condensed Medium,” “Kreuz Medium” and “Kreuz Extended Light” font software, said the plaintiff. The unlicensed font was used by Nike on audio-visual content for its YouTube channel, its website, store displays and third-party promotional content claimed Production Type, which now seeks no less than $150,000 in damages together with prejudgment interests and other costs from the American sportswear giant.
