Adidas America Inc. has filed a trademark-infringement suit against Edikted LLC, a self-described “Gen-Z-oriented online fashion brand, heavily influenced by pop culture, technology, and style.”
Operating on a “try and repeat model,” Edikted limits its inventory by producing “controlled amounts” of the styles its customers demand. It is headquartered in Los Angeles and possibly Tel Aviv and appears to generate revenues in the tens of millions of dollars. Its founders were also the founders of another fashion brand, Adika.
According to our colleagues at the American edition of SGI, Adidas is alleging that some of Edikted’s apparel bears two, three or four stripes, running down pant and short legs or along sleeves, and thereby infringes on its Three Stripe mark. The company alleges further that Edikted’s marketing images show models wearing the apparel with Adidas shoes. Adidas is seeking an injunction and disgorgement of profits, damages and fees.
Adidas lost similar cases, over Thom Browne’s four stripes and Nike’s three-stripe trousers, last year.
