Brooks Sports has appealed against a ruling by the U.S. Patent and Trademark Office (USPTO), which dismissed the running specialist's opposition to the registration of an Anta logo. Brooks filed its opposition on the grounds of potential confusion and dilution, in relation with its registered path and Heritage chevron marks. Anta, the leading Chinese sports apparel and footwear company, initially filed to register its own trademark in the U.S. in May 2014 for all types of footwear and apparel, describing it as “curving intersecting lines forming half an arrow.” Brooks' opposition was ultimately rejected in October 2017. Brooks has now asked the Virginia Eastern District Court to overturn the decision by the Trademark Trial and Appeal board of the USPTO, and to direct it to turn down Anta's registration.
