The Fashion Law has reported that Canada Goose is suing Goose Country, a U.S. outerwear brand. In the complaint, which was filed in the U.S. District Court for the Northern District of Illinois on June 30, Canada Goose claims that “the look and feel of the outerwear garments offered by Goose Country under the GOOSE COUNTRY Marks bears a remarkable similarity to the look and feel of the outerwear garments offered by Canada Goose under its GOOSE Marks.” Canada Goose also argues that the Goose Country marks are “similar in sight, sound, and commercial impression” to Canada Goose’s marks. According to the Canadian company, the defendant is on the hook for: federal trademark infringement, federal trademark dilution, federal unfair competition and false designation of origin, deceptive trade practices, unfair competition and trademark infringement under Illinois common law, and unjust enrichment. In addition to monetary damages and injunctive relief to bar Goose Country from infringing its rights in the trademarks at issue, Canada Goose is asking the court to order Goose Country to transfer ownership of its domain name www.originalgoosecountry.com as well “as any other domain name that incorporates the GOOSE COUNTRY marks and any other mark that is confusingly similar to or derived from the GOOSE COUNTRY marks, to Canada Goose.”
