A lawsuit against Nike in Missouri has been dismissed by the court following allegations that the company’s Sustainability Collection misled consumers about its use of sustainable materials. The lawsuit, filed by Maria Guadalupe Ellis in May 2023, claimed that Nike violated the Missouri Merchandising Practices Act.
According to Ellis, Nike falsely advertised the Sustainability Collection by promoting products as made from recycled materials, leading consumers to believe they were environmentally friendly. However, Ellis argued that most of the products did not live up to these claims. “The products from Nike are not less harmful to the environment,” Ellis stated in the complaint. “They are not made of ‘sustainable’ and eco-friendly materials.”
Despite Ellis’ assertions, the court found the arguments insufficient to proceed with the case, resulting in its dismissal. Nike’s advertising tactics were criticized for misleading consumers, with Ellis noting that only a small fraction of the products in the collection were actually made from recycled materials. While Ellis aimed to hold Nike accountable for what she perceived as greenwashing, the court’s decision means that Nike will not face further legal action in this matter.
