Under Armour has won a trademark infringement lawsuit against Aditya Birla Fashion and Retail Ltd. Under Armour filed the lawsuit after it came across the defendant using the logo “Street Armor” on sports apparel.
The Delhi High Court ruled that logos and motifs used by Aditya Birla Fashion and Retail Ltd. on its own sports apparel reading “Street Armor” were indeed infringing on the intellectual property rights of Under Armour and its “Under Armour” branding.
The defendant was ordered to refrain from using the impugned motifs and logos or any other mark deemed deceptively similar to those of Under Armour. The defendant has now been given three weeks to file an undertaking with the court.
Under Armour has been retailing in India since 2018. The company recently posted net revenues of nearly $1.4 billion for the fiscal fourth quarter ended March 31, 2023, driven by double-digit growth in both the EMEA and Asia-Pacific, while net income came in at $170.5 million versus a loss of $59.6 million a year ago. In the latest earning announcement, new CEO Stephanie Linnartz also outlined a new “Protect This House 3” series of objectives.
